Terms of Service

These Terms of Service (Terms) govern your use of the Your Build Mentor website (yourbuildmentor.com.au) and our member portal, services, and content (together, the Service). By using the Service, you agree to these Terms.

If you do not agree to these Terms, please do not use the Service.

1. Who we are

Your Build Mentor (we, us, our) is an Australian platform providing home-build guidance, tools, templates, and mentoring to homeowners. You can contact us at hello@yourbuildmentor.com.au.

2. Eligibility

You must be at least 18 years old to use the Service. By creating an account, you confirm that you are 18 or over and have the legal capacity to enter these Terms.

3. Account registration

To access most features, you'll need to create an account by providing accurate information about yourself and your build. You are responsible for:

  • Keeping your login credentials secure
  • All activity that occurs under your account
  • Notifying us immediately if you suspect unauthorised access

4. Subscriptions and payments

We offer two tiers of paid membership:

  • Build Essentials (standard $99/month, founding rate $69/month for the first 20 members)
  • Build Mentor (standard $299/month, founding rate $199/month for the first 20 members)

Annual billing is available with two months free.

Founding member rate applies only to the first 20 members and only while the membership stays active. If a founding member changes tiers, they will pay the founding rate of the new tier (subject to availability) or standard pricing.

Billing: Subscriptions are billed in advance on a monthly or annual basis through Stripe. By subscribing, you authorise us to charge your payment method on the schedule you select.

Auto-renewal: All subscriptions automatically renew at the end of each billing period unless cancelled.

Cancellation: You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. You will retain access until then.

5. Refunds

Subscription fees are generally non-refundable, except where required by Australian Consumer Law. If you believe you are entitled to a refund, please contact us at hello@yourbuildmentor.com.au.

6. The Service is guidance, not professional advice

This is important.

Your Build Mentor provides general guidance, educational content, tools, templates, and mentoring to help you navigate your home build. The Service is not a substitute for:

  • Legal advice from a qualified solicitor
  • Financial advice from a licensed financial advisor
  • Professional building inspection from a licensed building inspector
  • Architectural, engineering, or structural advice
  • Any other professional advice you should obtain for your specific build

You are solely responsible for your decisions and outcomes during your build. You should always consult appropriate professionals before signing contracts, accepting variations, or making other significant decisions.

7. Acceptable use

You agree not to:

  • Use the Service for any unlawful purpose
  • Share your login credentials with others
  • Reproduce, redistribute, or resell any of our content, tools, or templates without permission
  • Reverse engineer, copy, or scrape the Service
  • Upload content that is illegal, defamatory, or infringes another person's rights
  • Use the Service to harass, abuse, or harm another person

We reserve the right to suspend or terminate accounts that breach these Terms.

8. Intellectual property

All content on the Service (including text, graphics, tools, templates, frameworks, and the Service itself) is owned by Your Build Mentor or our licensors and is protected by copyright, trade mark, and other intellectual property laws.

We grant you a limited, non-exclusive, non-transferable licence to use the Service for your personal home build, while your subscription is active. You may not redistribute, resell, or commercially use our content without written permission.

9. Your content

You retain ownership of any content you upload (such as floor plans, contracts, build images). By uploading content, you grant us a licence to store, display, and process that content as necessary to provide the Service to you. We will not use your content for any other purpose without your consent.

10. AI mentor and automated content

The Service includes an AI mentor feature that provides automated responses based on YBM's content library and your build details. While we work to ensure the AI provides useful guidance, automated responses may sometimes be inaccurate, incomplete, or outdated. You should not rely solely on AI responses for important decisions. Always verify with appropriate professionals.

11. Service modifications

We may modify, suspend, or discontinue any part of the Service at any time. We will give you reasonable notice of significant changes that affect your subscription, where practical.

We may update these Terms from time to time. Significant changes will be communicated by email or through the Service. Continued use after changes means you accept the updated Terms.

12. Termination

We may suspend or terminate your account at any time if you breach these Terms or use the Service in a way we reasonably believe is harmful or unlawful.

You may terminate your account at any time through your account settings or by contacting us.

13. Limitation of liability

To the maximum extent permitted by law:

  • The Service is provided "as is" without warranties of any kind, express or implied
  • We do not guarantee the Service will be uninterrupted, error-free, or completely accurate
  • We are not liable for any indirect, consequential, or special damages arising from your use of the Service
  • Our total liability to you for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim arose

Nothing in these Terms excludes any rights you have under the Australian Consumer Law that cannot be excluded.

14. Indemnity

You agree to indemnify and hold harmless Your Build Mentor and its founders from any claims, damages, or losses arising from your breach of these Terms, your use of the Service, or your build decisions.

15. Governing law

These Terms are governed by the laws of Victoria, Australia. Any disputes will be resolved in the courts of Victoria.
